AI applications in this sector
Benefits allocation
AI systems that assess whether citizens are entitled to social provisions, allowances or benefits. High-risk under Annex III: direct impact on access to essential public services.
Law enforcement
Predictive policing, facial recognition and risk profiling by police and justice. Strictly regulated under Annex III, point 6. Real-time biometric identification is in principle prohibited (Article 5).
Border control and migration
AI for risk assessment in border control, visa applications and asylum requests. High-risk under Annex III, point 7. Requires additional safeguards for fundamental rights.
Public service chatbots
AI chatbots for providing information to citizens. Fall under transparency obligations (Article 50): citizens must know they are communicating with an AI system.
Fraud detection in public services
Algorithms that detect fraud in tax returns, allowances or benefits. The Dutch childcare benefits scandal showed how this can go wrong. The EU AI Act requires human oversight and non-discriminatory functioning.
High-risk classification
The EU AI Act (Regulation 2024/1689) classifies the following government applications as high-risk in Annex III:
Access to essential public services
Annex III, point 5(a)AI systems used by public authorities to evaluate whether persons are eligible for essential public services and benefits, including the granting, reducing, revoking or reclaiming thereof.
Law enforcement
Annex III, point 6(a-g)AI systems for risk assessment of natural persons, lie detection, evaluation of evidence, profiling in criminal investigations and assessment of recidivism risk. Article 26(3) requires a Fundamental Rights Impact Assessment.
Migration, asylum and border control
Annex III, point 7(a-d)AI systems for risk assessment at border control, verification of travel documents, assessment of asylum applications and detection of irregular migration. Fundamental rights of vulnerable groups require additional safeguards.
Specific challenges
Fundamental Rights Impact Assessment
Government organizations deploying high-risk AI systems are required to conduct a Fundamental Rights Impact Assessment (FRIA) under Article 27. This goes beyond a standard DPIA and requires specific expertise.
Public trust
The Dutch childcare benefits scandal and SyRI case have damaged public trust in government AI. Compliance is not enough: you must also transparently communicate how and why AI is deployed.
Procurement of AI from vendors
Many government organizations procure AI systems through tenders. The EU AI Act makes you co-responsible as a deployer. You must set requirements for vendors and be able to verify their claims.
Transparency obligations
Government has a special accountability duty. In addition to EU AI Act transparency requirements (Articles 13 and 50), the Open Government Act and GDPR also apply. Citizens have the right to explanation of automated decisions.
